For the umpteenth time, courts have knocked down an appeal by the real estate company against an injunction forcing them to restore the ancient monastery
The High Court of Justice in Murcia has dismissed an appeal by real estate company Hansa Urbana an order of December 29 2021 from Cartagena City Council requiring them to resume work on the Monasterio de San Ginés de la Jara monastery.Renovation work on the historic Monastery has been rumbling on for years, with Hansa Urbana obliged to fulfill a contract it signed to repair the building, which came part and parcel with an agreement they made to build a housing project on nearby land.That housing project could in the end not go ahead because the land was protected by the Mar Menor Law, but Hansa Urbana is still obliged to restore the old monastery as per the contract.A meeting of the Governing Board of the City Council of Cartagena, which was held on June 4 2021, approved an order to force the real estate company to resume refurbishment work, and Hansa Urbana has been appealing the decision ever since at successively higher courts.Cartagena City Council has already reiterated on multiple occasions that if the company does not carry out these works, they will hire someone else to do it and send the invoice to Hansa Urbana.“Once again, the courts have proved us right,” said Cartagena Deputy Mayoress and City Planning Councillor, Ana Belén Castejón. “Hansa Urbana has to undertake the rehabilitation works of the Monasterio de San Ginés and must do so now, without further delay. They must accept once and for all that it is their obligation and resume the work as soon as possible to avoid damage.”Image: Ayuntamiento de Cartagena
