Big changes to be made to sick leave in Spain in 2025
Social security is preparing a series of measures to more effectively control sick leave requests
Taking sick leave seems very straightforward for many in Spain. However this could all change in 2025 as there are radical changes that are going to take place in the new year. Until now, sick leave became effective from the fourth day or immediately in some cases, but now Social Security is preparing different measures to control these leaves in a more effective way.
Social Security has implemented new measures in which the companies one is employed by will be obliged to offer detailed information about the functions that the employee performs in his/her job, among other things.
This new measure is being put in place in order for the government to analyse each case individually or determine whether the temporary incapacity of the interested party from his or her job is really justifiable. In addition, there will be more administrative controls and medical assessments.
Going forward, it will now be the doctor who will directly send the report to the company so that there is greater control and transparency over the process of a person taking sick leave.
It has been claimed that the main objective of the new changes is to ensure that temporary disability processes are handled in a more effective way, benefiting both the workers themselves and the companies for which they work. The changes respond to the existing need for an adaptation and modernisation of the procedures related to sick leave.
However, with the arrival of the new changes, temporary disability will have a maximum validity of 18 months, since Social Security allows sick leave of 360 days, plus an extension of 180 additional days when the National Institute of Social Security determines that the worker will be able to recover in that period of time.
