Cold calls banned in Spain after June 29
Spanish companies will only be allowed to phone customers who have given their express consent
Consumers in Spain have seen the last of those annoying unknown numbers and disruptive marketing calls at dinner time, as a new law means that from June 29, companies won’t be allowed to ‘cold call’ potential clients unless they’ve expressly given their permission to be contacted.
The regulations will apply to all businesses aiming to market their goods or services and failure to comply will result in substantial fines. The General Telecommunications Law was actually approved last year but companies were given 12 months to come up with alternative advertising strategies.
Essentially, from the end of the month, Spanish consumers have the right “not to receive unwanted calls for commercial communication purposes, unless there is prior consent from the user to receive this type of commercial communication, or unless the communication can rely on another basis of legitimacy than those provided for in article 6.1 of Regulation (EU) 2016/679 on the processing of personal data.”
Unauthorised marketing calls will be banned to both mobile phones and landlines and the law will apply to businesses based in Spain as well as those with call centres in another country.
Customers who believe their rights have been contravened in this respect can lodge a complaint with the Spanish Agency for Data Protection (AEPD) which will thoroughly investigate the grievance and initiate legal action against the company where appropriate.
The only exceptions to this law are calls deemed essential to protect public interest and welfare.
