Driver in Spain fined 1,000 euros for using dashcam
The motorist was penalised by the Agency for Data Protection in Spain
Cameras placed on the dashboard of vehicles have been used for many years both in Spain and across the globe, with professional and private drivers swearing by them in the event of an accident.
More recently, motorists have taken to uploading the footage to social media with many dashcam videos going viral. And while their use isn’t prohibited by law, there is a very important regulation that drivers might ignore to their detriment, a very expensive lesson learned by one Galician motorist.
The event occurred in A Coruña when local police spotted the vehicle’s dashcam. The driver insisted he had had the device installed following a series of vandalism offences, and the officers decided to raise the issue with the Spanish Agency for Data Protection.
It was confirmed that the driver was in the wrong, as vehicle cameras can only film the exterior of the car if there is a justified reason; otherwise, the express permission of everyone being recorded needs to be sought. This, of course, was not the case, and the motorist was fined a substantial 1,000 euros.
It is important to note that current motoring law does not prohibit the installation of dashcams, but it is forbidden to record what’s going on outside if the vehicle is stationary. If the camera is used to capture footage of an accident or collision while the vehicle is in motion, it will be covered by national law.
