ARCHIVED - Galicia to introduce Covid passport for entry into nightlife venues
The Supreme Court in Galicia has overturned a decision to remove the requirement to show QR code proof
The Supreme Court has authorised the request of the regional government of Galicia to require patrons to present a ‘Covid passport’ in order to use the interior of hostelry and night life venues after the High Court overturned the measure last month. The measure was approved following an appeal lodged by Alberto Nunez Feijoo who argued that the passport system will significantly reduce Covid infections in the north-west region of Spain compared to the relatively small inconvenience caused to customers.
Even though well over 70 per cent of people in Spain are now fully vaccinated and are entitled to the Covid passport, the Spanish government has so far shied away from requiring it for entry into bars and restaurants, arguing that its initial intention was to support international travel only. Last month the High Court in Galicia agreed with this, insisting that the effectiveness of using a passport as an entry requirement hasn’t been satisfactorily proven and that in fact, it could cause a risk to privacy and equality.
Nevertheless, the Supreme Court has ruled this week that the requirement of a Covid passport to enter certain hospitality venues is “suitable, necessary and proportionate given that customers who are eating and drinking don’t wear masks for a large portion of time.” Furthermore, magistrate María del Pilar Teso pointed out that anyone unwilling to announce their vaccination status can either show proof of a negative test or having overcome the virus. Venues will simply need to see the documents and no private or medical data will be recorded or kept in any instance.
Magistrate Antonio Jesús Fonseca has strenuously opposed the ruling, claiming that it is blatant discrimination to require citizens to either prove they have been vaccinated when vaccinations aren’t mandatory, prove they have had a negative test when testing isn’t mandatory, or prove they have overcome the virus when so many people never contracted it in the first place.
