ARCHIVED - Ryanair sued for sacking Spanish union bosses
At the time of their dismissal, both workers were members of the cabin crew strike committee in Spain
The USO-Air Sector union in Spain has taken legal action against Ryanair for sacking two of its top members at the height of the cabin crew strikes, which are set to run until January 7.
General secretary of USO and cabin crew (TCP) in Girona, Lidia Arasanz, and Madrid-based union delegate, Manuel Lodeiro, received notice of their dismissal from the airline on October 20 for the “alleged commission of serious and culpable breaches of contract”.
Ryanair is already in hot water with the USO, who began legal proceedings against the carrier last month for an alleged “violation of freedom of association” during negotiations over pay and working conditions for cabin crew.
According to article 55 of the Workers’ Statute, when staff members who are let go are also union delegates, the company is obliged to open conflict proceedings which detail the complaints and sanctions being levied against them. At the time of dismissal, both crew members were members of the strike committee, and USO alleges that Ryanair failed to follow the correct procedures.
Furthermore, the union has accused the Irish airline of directly attacking “the union work of Arasanz and Lodeiro, top officials of the unions that have stood up to the company with the sole objective of stopping abuses against their workers and defending the rights of the TCP.”
Ryanair has defended the opening of disciplinary proceedings on the ground that the employees made misleading statements to the media regarding the minimum services guarantee imposed by the Spanish government at the beginning of the strike action this summer.
As well as demanding the immediate reinstatement of the dismissed union delegates, the USO has called for compensation for moral damages.
