ARCHIVED - Air Europa strikes: how to claim compensation if your flight is cancelled
Flights will be axed this week at airports across Spain as Air Europa pilots down tools
Air Europa is kicking off Bank Holiday Monday with a fresh round of travel disruptions as pilots for the Spanish airline down tools on Monday May 1, Tuesday May 2 and again on Thursday May 4 and Friday May 5. The strikes will affect bases all across Spain.
According to union Sepla, the work stoppages come as a result of “the tension and labour conflict generated by the directors of Air Europa playing with the rights of workers, disguising as proposals what is really a loss of labour rights acquired in the IV Collective Agreement."
Anyone who has a flight booked with Air Europa on the strike dates is advised to check the status of the trip on the airline’s website before travelling to the airport. Alternatively, passengers can use the Flight Tracker platform to check if their journey has been cancelled or changed.
Compensation
According to consumer organisation Facua, any passengers whose flights are cancelled will be entitled to a full refund of the ticket price “within seven days” or an alternative flight to the same destination. In addition, travellers may also claim compensation for other damages suffered as a result of the cancellation: hotels, organised trips, connecting flights and even moral damages.
Moreover, if the cancellation is last minute, the airline is obliged to offer “sufficient food and soft drinks”, accommodation and airport transfers, if appropriate.
How much can you claim?
European Regulation 261/2004 stipulates that passengers can claim compensation of 250 euros for cancelled flights up to 1,500 kilometres in distance. This increases to 400 euros for intra-community flights of more than 1,500 kilometres and to 600 euros for all other routes.
Requirements for claiming against Air Europa
If your Air Europa flight is cancelled, you will be entitled to make a claim provided:
- That the cancellation is due to a strike by Air Europa staff.
- That the strike causes a delay of more than three hours.
- That the airline has not communicated the cancellation or flight change within 14 days of the scheduled take-off.
- That the flight reservation has been confirmed.
