ARCHIVED - CaixaBank in Moratalla forced to refund thousands for unfinished urbanisation
Several buyers invested in the Murcia properties which were never built
CaixaBank has been ordered to refund more than 38,500 euros to several buyers who invested in properties in the El Balcón de Moratalla urbanisation. During the bankruptcy proceedings, it was detailed that the would-be home owners paid deposits on the houses in the Murcia municipality, which were originally put up for sale in 2007; however, the urbanisation was never built.
The court in Murcia found in favour of the buyers, who borrowed sums of money between November 2007 and May 2008 for the purchase of their future homes, which never materialised. The same authorities are now investigating whether there was a scam of some sort behind the failed project.
It was agreed during the proceedings that the sums of money paid by the customers were not advances of the purchase price, but rather penitential deposits. Furthermore, evidence submitted by the general secretary of the Moratalla City Council confirmed that the developer had been in breach of contract, since no first occupation licence had been granted.
