ARCHIVED - Covid passport is approved in the Valencia region
The Valencia Superior Court of Justice has ruled the measure is "suitable, necessary and proportionate"
The Superior Court in Valencia has authorised the mandatory use of the Covid passport to access leisure and hospitality venues with a capacity of more than 50 people and to visit hospitals and elderly residences.
A Covid certificate will also be required to attend music festivals, events and celebrations with more than 500 attendees. The order will be in place for a provisional 30 days, and President Ximo Puig has already made it clear he wants to have the scheme in place before the national long weekend to celebrate Constitution Day in Spain on December 6.
After being endorsed by the Public Prosectutor's Office on Friday November 26, the Litigation Chamber today concluded that "the measure is suitable, necessary and proportionate" because it aims to reduce the transmission of Covid and to avoid "more serious restrictions of rights".
It also considers the measures to be "balanced", as they are "more beneficial to the general interest – containment of the pandemic – than harmful to other conflicting goods or values".
According to a statement, the decision was also based on health data provided by the regional Ministry of Health which states that the risk of infection is lower amongst vaccinated people and that, in the event of infection, "the transmission of Covid is reduced between those who are immunised".
"The court also considers that the implementation of the Covid passport throughout the Valencia Community is justified in view of the continued upward trend of the pandemic curve throughout the region, the foreseeable crowds in the run-up to Christmas and the appearance of new variants of the Sars-Cov-2."
