ARCHIVED - Government approves major change in the sale of e-cigarettes in Spain
Within the next five years, e-cigs will be sold exclusively in tobacconists across Spain
There's been a huge boom in the sale of e-cigarettes in Spain over the last few years as millions of smokers opt for vapour devices as an alternative to traditional tobacco.
But over the next five years there will be a major clampdown on exactly where the electronic cigarettes are sold after the Spanish Government approved the Draft Bill of the Tobacco Market Law on Tuesday May 10.
The bill gives the same consideration to electronic and conventional cigarettes, which means they must be sold exclusively in tobacconists, a measure which must be implemented within a maximum period of five years.
According to the Executive, the objective is "to improve the control of the products, to review their advertising activities and to avoid sales to minors and through the Internet" and, consequently, "to guarantee the safety of consumers by ensuring that all the products that reach the consumer do so in a safe way".
The regulation will also bring Spain in line with the requirements of the European Union in terms of international conventions and treaties on tobacco control. It's also a recommendation by the World Health Organisation for the sale of these tobacco devices to be limited to establishments regulated by the State.
A statement from the government explains: "The law establishes an improvement in the supervision of tobacco-related products with the aim of ensuring that those that reach the consumer comply with European and Spanish regulations with full guarantees. This supervision will extend to all industrial and commercial activities in the sector: from the first transformation of raw tobacco to its sale to the customer."
The new bill also seeks to create a level playing field for all brands and manufacturers "so that one is not favoured over the other", and following international regulations, "duties of diligence" will be incorporated for tobacconists who will have to guarantee that all activities are carried out "with legal companies and for lawful purposes".
The regulatory powers of the Ministry of Finance and Public Function will be updated, as well as those of the Tobacco Market Commissioner, and new sanctions introduced to discourage any breaches.
