ARCHIVED - Spain approves abortion law which includes paid menstrual leave
The government in Spain has not yet agreed on reducing taxes on feminine hygiene products
On Tuesday May 17, the Spanish government formally approved the new abortion law, which gives women aged 16 and 17 the right to a pregnancy termination without parental consent and also grants monthly menstrual leave to women who suffer from painful periods, in addition to paid prenatal leave from the 39th week of pregnancy.
Women who wish to take sick leave due to menstruation must be diagnosed by a medical professional with a disease, such as endometriosis, fibroids, cysts etc.
The Voluntary Interruption of Pregnancy (IVE) articles in the legislation abolish guardianship for women with disabilities and eliminate the three days of reflection that are currently required of women seeking abortions.
The ministers have failed to reach a consensus on two important issues, which are still on the table for discussion.
Firstly, the Minister of Equality was hoping to eliminate the VAT charged on feminine hygiene products such as tampons and panty liners in supermarkets, or at the very least reduce the rate from 10% to 4%. This so-called ‘pink rate,’ which will cost an estimated 30 million euros, “will be negotiated again in the General State Budgets.”
Ministers have also yet to agree on changes to the law surrounding surrogacy, which is currently illegal in Spain but for a few legal loopholes.
