ARCHIVED - New Traffic Law comes into force in Spain: here are the major changes
Fines have not been increased but drivers in Spain can now lose more points from their licence
The long-awaited Traffic Law reform enters into force in Spain on Monday March 21 and brings a barrage of new regulations which aim to “improve the efficiency of the system and coexistence among all,” according to the DGT.
While the actual monetary fines haven’t been increased, drivers breaking the rules will face more points being taken away from their licence, and one of the major focal points of the Traffic authorities is eliminating distractions behind the wheel. Mobile phones are known to contribute to a huge number of accidents in Spain, and to this end, using or even just holding a phone while driving will now result in the loss of 6 points and a sanction of 200 euros.
Safety measures
- On conventional roads, drivers will no longer be allowed to exceed the speed limit by 20 km/h when overtaking.
- Failing to correctly use seatbelts or child restraints will result in a loss of 4 points.
- Throwing objects, such as cigarette butts, that can cause a fire or otherwise result in an accident, from a car window will carry a penalty of 6 points and a fine of 500 euros.
- Carrying radar inhibitors or speedometers in a vehicle is prohibited, whether the driver is actively using them or not, as the DGT maintains that these devices interfere with the proper functioning of traffic surveillance systems. Using them entails a loss of 3 points.

Bicycles, mopeds, motorbikes and personal mobility vehicles
- To ensure safety while overtaking a bike or moped, cars must completely occupy the adjoining lane on roads with two or more lanes in each direction. For single lane roads, a minimum safety distance of 1.5 metres from the bicycle or moped must be maintained, or 6 points will be lost from the licence.
- Motorcycle and moped drivers will be allowed to use certified wireless devices in their helmets for communication or navigation purposes. Not wearing a helmet will result in a reduction of 4 points.
- Drivers under the age of 18 (including those riding electric scooters) now have an alcohol limit of zero. Driving under the influence of alcohol is still considered a serious offence punishable by a fine of 500 euros.
